Who Is Eligible: Entrants must be legal residents
of Canada or any state in the U.S. except Florida, New York, or Rhode Island, and
must be 18 years or older at time of participation in the promotion
(“Promotion”). Employees of ASUS Computer International (“ASUS”), immediate
families, and their respective distributors, affiliates, parents, subsidiaries,
and advertising and promotional agencies are NOT ELIGIBLE. Void in Florida, New
York, and Rhode Island, and where restricted or prohibited by law. 2.

Agreement to these Rules. By
participating in this Promotion, entrant fully and unconditionally agrees to
and accepts these Rules and the decisions of the Sponsor, which are final and
binding in all matters related to the Promotion. Whether an entrant receives a
prize is contingent upon fulfilling all requirements set forth herein. 4.
Promotion period. Stage I of the Xtreme
Design campaign will begin on Oct. 22 at 9:00pm PST, and end on Nov. 6, at 5:00
pm PST (“Stage I Promotional Period”).
Stage II of the Xtreme Design campaign will
begin on Nov. 9 at 9:00am PST, and end on Dec. 7, at
5:00 pm PST (“Stage II Promotional Period”).
Stage III of Xtreme Design campaign will take
place at the Consumer Electronics Show (“CES”) in Las Vegas at the ASUS booth
in the Las Vegas Convention Center, from Jan. 7th ,
2010 to Jan. 10th (“Stage III Promotional Period”). 5.
Stage I Contest: To be eligible for the top
twenty (20) Xtreme Designs Winners of Stage I,
participants must be a member of [http://www.facebook.com/ASUSOfficialPage] and/or [http://www.hothardware.com] Winners of the Stage I Contest will be
selected on November 6, 2009. 6.
Stage II Contest.
Only the Stage I winners will be eligible to participate in the Stage II
Contest. To enter the Stage II Contest,
the Stage I winner must blog about his or her experiences (each a “Blog”) in
using his or her Stage I Prize during the Stage II Promotion Period on the
following eligible pages: 7.
Judging of the Submissions for
Stage I: The Submissions will be judged by a panel of
qualified judges selected by Sponsor at Sponsor’s sole discretion. The judges will select the Stage I winners
based upon the Submission’s effective explanation and use of system project
goals, anticipated challenges, diagrams, pictures, videos and sketches, in
explaining why the entrant is capable of building an Xtreme
Design. Twenty (20) Eligible users will
be chosen by the judges at the judge’s discretion on Nov. 6th 2009,
as eligible candidates to take part in the Stage II Contest. These candidates will be interviewed by one
or more of the judges to determine if such candidate is able to effectively fulfill
the Stage II Blog requirements. If the
judge(s) feel the candidate is not able to effectively fulfill the Stage II Blog
requirements, the judge(s) will pick the candidate with the next highest score
from Stage I. If the judge(s) feel the
candidate is able to effectively fulfill the Stage II Blog requirements, the
Candidate shall be a Stage I Winner. Candidates
and Winners will be notified via a message on Facebook,
forums, and email, at the email address provided in the participant’s
registration profile. The Stage I prize will be shipped via ground delivery to
the Winner’s attention at the address provided in the Winner’s registration
profile. 8.
Stage II Blog Requirements. Stage I Candidates must be able to fulfill 2
or more elements in the following Stage II Blog Requirements: post comments about the experiences in using
the Stage I Prize for 30 days in any of the participating forums set forth in
Section 6; post pictures and videos of the Stage I prize; post comments about building a system from
the Stage I prize; describe and post photos or drawings relating to the build process;
post screen shots of the system and performance data, and describe feelings
about the Xtreme Design. 9. Judging
of the Blogs for Stage II: The Stage II Blogs will be judged by a panel of
qualified judges selected by Sponsor at Sponsor’s sole discretion. The judges will select one (1) Grand Prize
Winner and four (4) runner up Stage II Grand Prize Winners based upon each
Candidate’s effective fulfillment of the Stage II Blog Requirements,. 10. Stage II Prizes,
Approximate Retail Value: Each of the four (4) Stage II runner up winners will
receive ASUS P7P55D Premium motherboard, Intel Core i7 860 CPU, Antec Quattro 850 watt PSU, ASUS GTX260 GPU, G.Skill 4GB TDS memory kit, Razer
Lycosa keyboard, Razer Deathadder mouse, and Samsung 128GB SSD drive. _(“Stage II Hardware
Prize”). Approximate retail value (“ARV”) is 1,800_ for each Stage II Hardware
Prize, for a total of $__36,000_ ARV for all 4 prizes. The Stage II Grand Prize Winner will receive
one (1) Stage II Hardware Prize at an ARV of $1,800________, and a trip for one to Las Vegas, Nevada, at an ARV
of $_2,000_____. The Grand Prize
includes: airfare from the closest major airport to Grand Prize Winner’s
residence in the U.S. to Las Vegas, Nevada for one (1) adult, ____ (_4_) nights
at the _Courtyard Hotel, transportation to and from the airport and hotel. 11. Total ARV of all
Stage I Prizes, Stage II Prizes, and Grand Prize: $_38,000_. 12. How to Claim Your Prize: All Winners
will be notified via a message on Facebook, forums,
and email, address provided in the participant’s registration profile. The
winner must meet all eligibility requirements set forth in these Official Rules
to qualify for a prize. Prize winners must complete an
eligibility and liability/publicity release or prize may be forfeited
and awarded to an alternate winner. The prize shipped to his or her attention
at the address provided in the registration profile. 13. No purchase
necessary. All federal, state, and local taxes on the prize are the sole
responsibility of the winner. 14. The Prize is not
transferable and no cash alternative or prize substitutions are available,
except that ASUS reserves the right to substitute cash or a similar prize of
equal or greater value should the prize listed be unavailable for any reason. 15. This contest is
governed by California law and is subject to all applicable federal, state, and
local laws and regulations. 16. In the event the
winner does not accept delivery of any prize, the prize may be used as an award
at a future event. 17. By entering the
Promotion, you release and agree to hold harmless ASUS and other suppliers and
their officers, directors, employees, representatives, agents, advertising,
promotion, production and fulfillment agencies, successors and assigns from and
against any liability of any kind in connection with the Promotion, including
without limitation any costs, fees, expenses, or damages incurred in the use of
the prize. 18. License to
Sponsor. Acceptance
of any prize shall constitute and signify winner’s agreement and consent that
Sponsor may use the winner’s name, city, state, likeness, posted comments,
images, videos, final system used in entering the Promotion, and/or prize
information in connection with the Promotion, worldwide, including the
Internet, without limitation and without further payment or consideration,
except where prohibited by law. Furthermore, uploading a Submission or a
Stage II Blog entry constitutes entrant’s consent to give Sponsor a
royalty-free, irrevocable, perpetual, non-exclusive license to use, reproduce,
modify, publish, create derivative works from, and display any and all such
information in whole or in part, on a worldwide basis, and to incorporate it
into other works, in any form, media or technology now known or later
developed, including for promotional or marketing purposes. If necessary, entrant will sign any necessary
documentation that may be required for Sponsor or its designees to make use of
the non-exclusive rights entrant is granting hereunder. 19. Limitations of
Liability:
The Sponsor is not responsible for: (1) any incorrect or inaccurate
information, whether caused by entrant, printing errors or by any of the
equipment or programming associated with or utilized in the Promotion; (2)
technical failures of any kind, including, but not limited to malfunctions,
interruptions, or disconnections in phone lines or network hardware or
software; (3) unauthorized human intervention in any part of the entry process
or the Promotion; (4) technical or human error which may occur in the
administration of the Promotion or the processing of entries; (5) late, lost,
undeliverable, damaged or stolen mail; or (6) any injury or damage to persons
or property which may be caused, directly or indirectly, in whole or in part,
from entrant’s participation in the Promotion or receipt or use or misuse of
any prize. Sponsor is not responsible for misdirected or undeliverable entries
or for any technical problems, malfunctions of computer systems, servers,
providers, hardware/software, lost or unavailable network connections or
failed, incomplete, garbled or delayed computer transmission or any combination
thereof. Sponsor is not responsible for any typographical/other error in
entries, selection announcement or for any liability for damage to any computer
system resulting from participation in, accessing or downloading information in
connection with this Promotion. If for any reason an entry is confirmed to have
been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s
sole remedy is another entry. No more than the stated number of prizes will be
awarded. 20. Disputes: Except where
prohibited, entrant agrees that: (1) any and all disputes, claims and causes of
action arising out of or connected with this Promotion or any prize awarded
shall be resolved individually, without resort to any form of class action, and
exclusively by the United States District Court for the Northern District of
California or the Santa Clara County Superior Court, U.S.A.; (2) any and all
claims, judgments and awards shall be limited to actual out-of-pocket costs
incurred, including costs associated with entering this Promotion, but in no
event attorneys’ fees; and (3) under no circumstances will entrant be permitted
to obtain awards for, and entrant hereby waives all rights to claim, indirect,
punitive, incidental and consequential damages and any other damages, other
than for actual out-of-pocket expenses, and any and all rights to have damages
multiplied or otherwise increased. All issues and questions concerning the
construction, validity, interpretation and enforceability of these Official
Rules, or the rights and obligations of the entrant and Sponsor in connection
with the Promotion, shall be governed by, and construed in accordance with, the
laws of the State of California without giving effect to any choice of law or
conflict of law rules (whether of the State of California or any other jurisdiction),
which would cause the application of the laws of any jurisdiction other than
the State of California. 21. Taxes: Winners are
solely responsible for any taxes. Prizes consist of only the item specifically
listed and no additional services or subscriptions are included. Winner agrees
that the prizes are being provided “as is,” and ASUS and other suppliers make
no warranty, representation, or guarantee regarding any prize, including but
not limited to its quality, condition, merchantability, or fitness for a
particular purpose. Winner must look solely to the manufacturer for any such
warranties or guarantees. Odds of winning will depend on the number of eligible
registrants at the time of the judging and quality of posts. 22. Entrant's
